Sweet Squad Affiliate Program Terms

Please read these terms before you join. By applying to join, or by using the new code we send you when you claim your Sweet Squad upgrade, you agree to them. In short: you earn commission on sales through your link or code, your rate goes up as you sell more, top sellers can earn cash bonuses, and you must clearly show that your posts are ads.
1. About these terms
1.1 The Sweet Squad affiliate program (the Program) is run by Misfits Health Inc., a Delaware corporation with its office at 447 Broadway, 2nd Floor, New York, NY 10013 (Misfits, we, us). "You" means the person who joins the Program.
1.2 You agree to these terms by applying to join the Program or, if you were already a Misfits affiliate, by using the new code we send you when you claim your Sweet Squad upgrade. They form a contract between you and us when we confirm that you have been accepted into the Program. Applying, or claiming an upgrade, is a request to join. It does not bind us until we accept you.
1.3 If you were a Misfits affiliate before the Program Start Date, these terms apply to you only once you claim your Sweet Squad upgrade and use the new code we send you. Until then, your existing code keeps earning 20% commission on your existing basis, and you are not eligible for levels, level rewards or Top Seller Bonuses.
1.4 If we also agree a separate paid campaign or content deal with you (for example a product launch or a paid content deal), the terms of that deal apply to that work. These terms apply to everything else you do in the Program.
1.5 The Program page at eatmisfits.com/pages/the-sweet-squad summarizes the Program. If anything on that page or in any other material conflicts with these terms, these terms win.
2. Joining and eligibility
2.1 To join and stay in the Program you must:
- be at least 18 years old (19 in Alabama and Nebraska, 21 in Mississippi);
- live in one of the 50 US states or the District of Columbia;
- have at least 1,500 followers on Instagram or TikTok (we may accept people with fewer at our discretion);
- have an account on Upfluence or any other platform we tell you to use to run the Program (the Platform), and set up payouts on it; and
- not be an employee, contractor or agency of Misfits, or a member of the household of any of them.
2.2 We decide who joins. We may accept or decline any application, for any reason or none.
2.3 Everything you tell us when you apply must be true, including your follower numbers. You must not buy followers, likes or views or use bots to inflate your numbers.
3. Your link and code
3.1 When we accept you, we will give you a personal affiliate link and a personal discount code. Your followers get 20% off products on our US online store (eatmisfits.com) with your code, once per customer. We decide which other offers your code can be combined with, and may change this.
3.2 A sale is credited to you if the customer either:
- uses your code at checkout; or
- clicks your link and buys within 30 days of their last click on it.
3.3 If a customer uses one affiliate's code but last clicked another affiliate's link, the sale goes to the owner of the code.
3.4 Your link and code are personal to you. Only share them in your own posts on the channels allowed by section 10. You must not transfer, sell or share them with anyone else.
3.5 We may change or deactivate a code at any time, for example if it has been posted on a coupon site. If we replace your code, we will give you a new one.
4. What counts as a sale
4.1 A Qualifying Sale is one order placed on our US online store (eatmisfits.com) that is credited to you under section 3 and is not excluded by this section. One order counts as one Qualifying Sale, however many items are in it.
4.2 An order is not a Qualifying Sale if:
- it is placed by you, or by anyone living at your address;
- it is cancelled, or fully refunded or charged back, within 30 days of the order date;
- it is a wholesale, business-to-business or retail-partner order, or an order through Amazon, any other marketplace, a retail store or any non-US Misfits store;
- it only buys a gift card;
- it came through a coupon or deal site, or any other channel section 11 does not allow; or
- we reasonably believe it is fraudulent, or was placed to inflate your numbers (for example, many small orders to the same address or payment card).
4.3 The first order of a new subscription is a Qualifying Sale. Later subscription renewals are not Qualifying Sales and earn no commission.
4.4 Net Sales Value means what the customer actually pays for products in a Qualifying Sale, after all discounts, and excluding sales tax, shipping charges and gift cards. Bundles and sale-priced products count at the price paid.
4.5 Our records of orders on our store and on the Platform are final, unless they contain an obvious error. You can see your clicks, sales, level and payouts on your Platform dashboard. If you think something is wrong, tell us within 60 days of the end of the month it relates to.
4.6 If you join the Program, or claim your Sweet Squad upgrade, on or before 30 November 2026, all orders credited to you from 1 November 2026 count towards your level and Top Seller Bonuses, as if you had been in the Program from that date.
5. Commission
5.1 You earn commission on the Net Sales Value of each Qualifying Sale, at the rate for your level in the month the order was placed (see section 6).
5.2 Commission is confirmed once the 30-day refund window in section 4.2(2) has passed. If a Qualifying Sale is refunded or charged back after we have paid you commission on it, we will deduct that commission from your next payment. We will only ask you to repay money directly if the refund relates to fraud or a breach of these terms.
5.3 Commission is our only payment for your posts and other activity in the Program, unless we agree something else in writing under section 1.4.
6. Levels and level rewards
6.1 There are three levels:

6.2 Your level for each calendar month is set by the number of Qualifying Sales credited to you in the previous calendar month, counted on the 5th day of the month. Your rate for the month applies to all your Qualifying Sales in that month. Refunds after that date do not change a level already set.
6.3 Levels reset each month. If your sales drop below a level's threshold, you move to the level that matches the previous month's sales.
6.4 Level rewards. The first time you reach Sweeter, we will send you a Misfits tote bag. The first time you reach Sweetest, we will send you Misfits sweats and a t-shirt. Each level reward is given once per person, to a US address. If a parcel is returned because the address you gave is wrong, we will not resend it.
6.5 Sweetest perks. While you are at Sweetest, you are eligible for early access to new flavors, a feature on @eatmisfits and invitations to our PR box list. These perks are at our discretion and are not guaranteed.
7. Top Seller Bonuses
7.1 On top of commission, we pay a cash bonus (a Top Seller Bonus) to the affiliate with the most Qualifying Sales in each Bonus Period, as long as they reach the minimum for that period:

7.2 Top Seller Bonuses are a reward for sales. They are not a contest, sweepstakes or prize draw, and there is no element of chance. No purchase is needed to join the Program.
7.3 If two or more affiliates have the same number of Qualifying Sales, the bonus goes to the one with the higher Net Sales Value in the Bonus Period. If that is also equal, it goes to the one who reached the minimum first. If they are still tied, we split the bonus equally between them.
7.4 If no one reaches the minimum, there is no bonus for that Bonus Period and nothing carries over to the next one.
7.5 You can earn more than one Top Seller Bonus for overlapping periods (for example, a monthly and a quarterly bonus), and you can earn the monthly bonus in any number of months.
7.6 We count Qualifying Sales for a Bonus Period once the 30-day refund window has passed for the last orders in it. We will tell the winner, and pay a cash bonus with commission, on the 15th day of the second month after the Bonus Period ends. For example, the bonus for November 2026 is paid on 15 January 2027.
7.7 To receive a bonus you must still be in the Program when it is paid, unless we removed you for a reason other than fraud or a serious breach of these terms.
7.8 We may pay any non-cash bonus as cash of equal value instead.
8. The annual London trip
8.1 If the annual winner chooses the trip, we will provide:
- economy return flights for the winner and one guest from a major US international airport we choose near the winner's home;
- three nights in a standard double room at a London hotel we choose;
- airport transfers in London; and
- a spending allowance of $480 for the trip, paid through the Platform before travel.
8.2 The trip does not include travel to or from the US departure airport, travel insurance, passports or visas, meals or drinks beyond the allowance, or personal spending. These are the winner's responsibility. The total value of the trip is approximately $6,000.
8.3 The trip must be taken within 12 months of the date we notify the winner, on dates we agree, but not between 15 December and 5 January. Once the winner confirms dates and we book, the dates cannot be changed and bookings are non-refundable.
8.4 The guest must be at least 18 and must sign our short release and publicity consent before we book. The winner and guest must hold valid travel documents for travel to the UK.
8.5 The trip cannot be transferred to anyone else. If the winner cannot travel within the 12 months, we will pay the cash amount in section 7.1 instead.
8.6 Any visit to Misfits during the trip is optional. We will only film, photograph or post about the trip with the winner's and guest's consent.
9. Payment and tax
9.1 We pay commission for each calendar month on the 15th day of the second month after it. For example, commission on Qualifying Sales in November 2026 is paid on 15 January 2027. We pay the whole balance each month, however small.
9.2 We pay through the Platform's payment system (currently Upfluence Pay, powered by Stripe). To be paid, you must complete the payout set-up, including any tax form it asks for. If you have not, we will hold your payments until you do. We pay the Platform's charges for sending payments. You pay any fee you choose to incur, such as an instant payout fee, and your own bank's charges.
9.3 Commission, Top Seller Bonuses and the value of any trip or level reward may be taxable income for you. You are responsible for your own taxes. You must give us, or the Platform, a completed Form W-9 when asked. Your earnings may be reported to the IRS on Form 1099.
9.4 We may deduct from any payment amounts you owe us under section 5.2, and withhold payment for Qualifying Sales we are investigating under section 4.2(6) until we have finished.
10. Posting rules
10.1 Where you post. You may promote Misfits on Instagram and TikTok. You need our written OK (email is fine) to promote Misfits anywhere else.
10.2 Show it is an ad. The law requires you to make clear that you are paid by us, because you get free products, commission and the chance of bonuses. In every post, story, reel or video that mentions Misfits, you must:
- switch on the platform's paid partnership label ("Paid partnership" on Instagram; the commercial content disclosure on TikTok); and
- put #ad in the caption where it can be seen without tapping "more".
Do not hide #ad among other hashtags, put it only in your bio, or rely on words like "#sp", "#collab" or "thanks Misfits" instead.
10.3 Be honest. Only post about Misfits products you have actually tried, and give your real opinion.
10.4 Claims. Only describe our products using their taste and flavor, and the product facts printed on our packaging or in our content kit. You must not make any health, medical, weight-loss or nutrition claim (for example, that a bar is "healthy", helps you lose weight, or treats or prevents any condition) unless it is printed on our packaging or in our content kit, word for word.
10.5 Your content must not: break any law or any platform's rules; use music, images or other material you do not have the right to use; show anyone who has not agreed to appear; be offensive, discriminatory, sexually explicit or dangerous; or make false or unfair statements about Misfits, other brands or competitors.
10.6 We do not approve posts before they go up. If we ask you to edit or remove a post that mentions Misfits, you must do so within 48 hours.
11. Things you must not do
You must not:
- post or allow your code on coupon, deal, voucher or cashback websites or browser extensions (for example Honey or RetailMeNot);
- run paid search ads, or bid on "Misfits" or any of our brand or product names as keywords;
- run or boost any paid social ads of your own promoting Misfits, your link or your code;
- send unsolicited emails, texts or direct messages (spam) to promote your link or code;
- buy through your own link or code, or ask friends or family to buy just to raise your numbers;
- offer customers any part of your commission, cash back or any other incentive to use your code;
- register or use any website, domain name, social handle or ad account that includes "Misfits", or present yourself as Misfits or as speaking for us; or
- do anything that brings Misfits into disrepute.
12. Your content
12.1 You own the content you create.
12.2 You give us a free, non-exclusive, worldwide, permanent license to repost, share and display any post you make that mentions Misfits on our own channels: our social media accounts, website and emails. We will credit you where practical. We may crop, resize or caption it to fit, but will not change what you say.
12.3 You also give us a free, non-exclusive license to use any post you make that mentions Misfits in paid advertising on social media and online, including Spark Ads, partnership ads and ads run through your account (whitelisting). This includes your name, social handle, image and voice as they appear in the post. The license lasts for 12 months from the date of each post. We will use your post as you made it: we may crop or resize it, or add captions or a call to action, but will not change what you say. Ads using your content will always show that they are a paid partnership with you.
12.4 When we ask, you will give us the authorization code or account access we need to run your post as a Spark Ad, partnership ad or whitelisted ad. You can opt out of paid use of your posts at any time by emailing us at the address in section 21.2. After that, we will not start any new ads using your posts, but ads already running may continue until the end of their 12 months.
12.5 You confirm that you have all the rights needed for us to use your content in this way, including for any music, images and people in it.
13. Welcome box and gifts
13.1 When we accept you, we will send you one welcome box (Misfits products, a note and a Misfits keychain) to a US address. One welcome box per person.
13.2 Welcome boxes, level rewards and any other products or merchandise we send you are gifts. You do not have to post in return, but if you do post about them, section 10 applies.
14. Group chat and extra competitions
14.1 We may invite you to a Sweet Squad group chat. In it you must be respectful, not share anyone else's personal details or codes, and not make side deals with other members. We may remove anyone from the chat.
14.2 We may run extra competitions for Program members from time to time. Each will have its own short rules, which we will share before it starts. Any extra competition will be decided on sales or other measurable performance, never by random draw.
15. Publicity
15.1 You agree that we may announce Top Seller Bonus winners and feature Program members, using your social handle and, if you agree, your first name, in the group chat and on our own channels.
16. Changes and ending the Program
16.1 We may change these terms or the Program, including commission rates, level thresholds and bonuses, by giving you at least 30 days' notice by email or through the Platform. Changes apply from the date in the notice. They do not affect:
- commission on Qualifying Sales made before that date; or
- any Bonus Period that has already started, which runs to its end on the existing terms.
16.2 If you do not agree with a change, you can leave the Program under section 17.1. If you stay after the change takes effect, the changed terms apply to you.
16.3 We may end the Program by giving at least 30 days' notice. If we do:
- we will pay all commission due on Qualifying Sales made before the end date;
- any monthly or quarterly Bonus Period already under way will run to its end and be paid as usual; and
- for the annual bonus, we will pay the cash amount in section 7.1 to the affiliate with the most Qualifying Sales from the start of that year to the end date, if they reach a minimum reduced in proportion to the part of the year that has passed.
17. Leaving or removal
17.1 You can leave the Program at any time by telling us by email or through the Platform.
17.2 We may remove you from the Program at any time by telling you by email or through the Platform. We may do this for any reason, including if you have not posted about Misfits or made a Qualifying Sale for 90 days.
17.3 If you leave or are removed, your link and code will stop working. We will pay you commission on Qualifying Sales made before that date, and any Top Seller Bonus already awarded to you, at the usual times.
17.4 Section 17.3 does not apply if we remove you for fraud or a serious breach of these terms. In that case we do not have to pay commission on sales affected by the fraud or breach, or any bonus that it affected.
17.5 Sections 4.5, 5.2, 9, 12, 15 and 18 to 21 continue to apply after you leave.
18. You are independent
18.1 You take part in the Program as an independent contractor. You are not our employee, agent or partner, and you cannot make promises or agreements on our behalf.
18.2 You decide when, whether and how you post, within these terms. You are not exclusive to us and can work with other brands.
19. Liability
19.1 We do not promise that links, codes, tracking or the Platform will always work. We are not responsible for sales that are not tracked because of something outside our reasonable control, for example a customer's browser blocking tracking.
19.2 Our total liability to you under these terms is limited to the commission and bonuses due to you under them, plus $1,000. We are not liable for any lost profits, lost opportunities or indirect losses. Nothing in these terms limits liability that cannot be limited by law.
19.3 You will cover our reasonable losses and costs (including reasonable legal fees) arising from any claim by a third party or regulator caused by your breach of sections 10, 11 or 12.5.
20. Your information
20.1 We use your personal information to run the Program, pay you and meet our legal and tax obligations, as explained in our Privacy Policy at eatmisfits.com/policies/privacy-policy. The Platform uses your information under its own privacy policy.
21. General
21.1 These terms, together with any separate deal under section 1.4, are the whole agreement between you and us about the Program.
21.2 We may send you notices by email to the address you gave us or through the Platform. You can send notices to us at affiliates@eatmisfits.com.
21.3 You may not transfer your rights or obligations under these terms. We may transfer ours to another company in the Misfits group.
21.4 If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
21.5 These terms are governed by the laws of the State of New York. Any dispute about them will be dealt with only by the state or federal courts in New York County, New York.
